1. Acceptance of Terms
By accessing and using the Bespot Analytics Platform (“Service”), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. License and Acceptable Use
Subject to these Terms and your plan limits, we grant you a limited, non‑exclusive, non‑transferable license to access and use the Service for your internal business purposes. You may not: (a) reverse engineer or attempt to extract source code; (b) access the Service to build a competing product; (c) use the Service to violate law or infringe rights; (d) exceed or circumvent usage or rate limits; (e) introduce malware or harmful code.

3. Service Description
The Bespot Analytics Platform provides fraud detection and analytics services. The Service includes but is not limited to:

Real-time fraud detection
Analytics dashboard and reporting
API access for integration
Data visualization tools

4. User Responsibilities
You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Ensuring your use of the Service complies with applicable laws
Providing accurate and up-to-date information

5. Prohibited Uses
You may not use the Service:

For any unlawful purpose or to solicit others to perform unlawful acts
To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
To infringe upon or violate our intellectual property rights or the intellectual property rights of others
To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate

6. Data and Privacy
We process personal data as described in our Privacy Policy and, where applicable, under a Data Processing Addendum (DPA). You are responsible for obtaining necessary notices and consents from your end users. Cross‑border transfers are governed by appropriate safeguards (e.g., SCCs/UK Addendum) where required.

7. Service Availability
We strive to maintain high service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.

8. Limitation of Liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Our aggregate liability arising out of or relating to the Service will not exceed the fees you paid in the twelve (12) months preceding the event giving rise to liability.

9. Suspension and Termination
We may suspend or terminate the Service for breach, security risk, or legal compliance. Upon termination, your license ends and you must cease use. We will handle Customer Data per our retention policy and any applicable DPA.

10. Regional Terms (GDPR/UK GDPR, LGPD, US)
Additional rights may apply to you by law. EU/UK residents have GDPR/UK GDPR rights as detailed in the Privacy Policy. Brazil residents have LGPD rights (including ANPD oversight). California residents have CPRA/CCPA rights, including opt‑out of “sale/share” where applicable. These Terms do not limit non‑waivable consumer rights.

11. Governing Law and Venue
Unless otherwise required by consumer law in your region or agreed in an order, these Terms are governed by the laws of England and Wales. The courts of London, UK have exclusive jurisdiction. Mandatory local consumer protections and venues remain unaffected where required.

12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
